BUCKCHERRY Lawyer Issues Statement On Underage Lawsuit
September 14, 2006Launch Radio Networks reports: BUCKCHERRY's attorney has issued a statement regarding the lawsuit filed against the band last week that claimed that an underage girl was allegedly enticed by the group to expose her breasts, kiss another female and dance provocatively in the unedited video for the single "Crazy Bitch". Lawyer Skip Miller said in his statement, "The claims in this case are completely bogus. This woman obtained access to the video shoot by using a phony ID. Strict precautions were taken to insure that only people over the age of 18 would gain access to the shoot. The casting ad called for talent over 18 only, signs were posted to that effect at the venue and IDs were checked. This person signed a talent release form and verified her age by writing what we have now discovered to be a false birth date on the release to match her phony ID. She was later seen boasting into the camera about her exploits in the video."
Miller concluded by adding, "This lawsuit was filed almost a year after the video was shot, following the financial success of the band. We are going to defend this action vigorously and let the evidence speak for itself."
In the suit, filed in Los Angeles County Superior Court, the 16-year-old plaintiff — identified only as Jane Doe — claimed emotional distress after the unedited version of the video was widely distributed online. She is seeking unspecified damages from the band and its record label, Atlantic.
The girl appeared at the video shoot after answering a call for extras posted at the band's MySpace page. The clip has now been re-edited to remove her image.
The plaintiff's lawyer, Douglas Silverstein, said, "You can imagine the panic this girl felt when this video started getting aired. She's been called a lesbian at school. She's had to switch schools because of that video."
"Crazy Bitch" comes off BUCKCHERRY's third album, titled "Fiftenen", which debuted at a career best No. 48 on the Billboard Top 200.
